1.The resort accommodations reservation program powered by SkyAuction.com is provided by Worldwide Vacation & Travel, Inc. d/b/a Interval Travel (WVT), a Florida corporation with a principal place of business at 9995 S.W. 88th Street, Miami, Florida 33176. WVT and its affiliated companies shall be collectively referred to herein as the "Providers". |

WVT is registered as a State of Florida Seller of Travel, Registration Number 10224; a State of Washington Seller of Travel, Registration Number 601 765 244; and a State of California Seller of Travel, Registration Number 2030985-50; a State of Nevada Seller of Travel, Registration number 2003-0412. Iowa Seller of Travel, Registration Number 837. |

| 3. YOUR COMPLETION OF A RESORT ACCOMMODATIONS RESERVATION CONSTITUTES YOUR ACCEPTANCE OF ALL THE TERMS AND CONDITIONS CONTAINED HEREIN. YOU MUST BE A LEAST 21 YEARS OF AGE TO RESERVE OR USE RESORT ACCOMMODATIONS. YOU MAY NOT RESERVE ACCOMMODATIONS FOR INDIVIDUALS UNDER THE AGE OF 21. |

| 4. YOU ARE RESPONSIBLE FOR THE ACTS AND OMISSIONS OF THE INDIVIDUALS OCCUPYING THE ACCOMMODATIONS ("OCCUPANTS"), INCLUDING ANY LOSS OR DAMAGE TO THE ACCOMMODATIONS. |

5. Depending on the date you cancel your vacation condominium rental, you may be entitled to a refund. Should you determine that you must cancel your vacation condominium rental, please contact SkyAuction.com immediately by e-mail (condorentals@skyauction.com) and provide the following information:
- Your name exactly as it appears on your rental confirmation certificate
- Your daytime telephone number
- Your rental confirmation certificate reference number.
Depending on the date you cancel your vacation condominium rental, you may be entitled to a refund.
For rental transactions cancelled 15 days or more prior to the check-in date, a refund will be issued for 100% of the rental price paid by you.
For rental transactions cancelled within 14 days prior to the check-in date a refund will be issued for 50% of the rental price paid by you.
Rates are quoted in U.S. dollars unless otherwise specified. |

6. The Providers have no legal or beneficial interest in any developer, seller, or managing entity of any host resort participating in the resort accommodations reservation program. |

7.YOU AGREE THAT, IN ALL INSTANCES, THE PROVIDERS' LIABILITY TO YOU, YOUR FAMILY, YOUR GUESTS AND/OR THE OCCUPANTS FOR ANY AND ALL LOSSES OR EXPENSES INCURRED BY YOU OR THEM AS A RESULT OF YOUR RESERVATION OF RESORT ACCOMMODATIONS AND/OR THE USE AND OCCUPANCY OF SUCH RESORT ACCOMMODATIONS, INCLUDING BUT NOT LIMITED TO ANY DAMAGE, LOSS, OR THEFT TO PERSONAL PROPERTY LEFT IN THE ACCOMMODATIONS OR ANY PERSONAL OR BODILY INJURY WHICH OCCURS AT THE RESORT SHALL BE LIMITED TO THE AMOUNT OF THE PRICE PAID BY YOU TO RESERVE THE RESORT ACCOMMODATIONS, PLUS ANY APPLICABLE TAXES PAID. IN NO SUCH INSTANCE SHALL THE PROVIDERS BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES ARISING FROM YOUR RESERVATION OF RESORT ACCOMMODATIONS OR THE USE AND OCCUPANCY OF SUCH ACCOMMODATIONS. |

8. The Providers shall not be liable for any injury, loss, damage, accident, delay, irregularity, or expenses arising from strikes, war, weather, quarantines, sickness, government restrictions or regulations, or from any act or omission of any other service in connection therewith, nor for any additional cost or expense due to disruption or change of advertised schedules, rates, or services, acts of God, or for any other cause beyond their reasonable control. |

| 9. You are responsible for all taxes associated with the use/sale of the resort accommodations. In addition, some jurisdictions may impose a tax on the transient occupancy of resort accommodations. Any applicable bed tax, transient occupancy tax, transient accommodations tax or similar tax imposed on the use of reserved resort accommodations shall be your responsibility and you or the Occupants, as applicable, will be requested to pay such taxes. You or the Occupants, as applicable, are also responsible for all personal charges incurred by you, your guests or the Occupants (e.g., telephone calls, meals, and use of some resort amenities), utilities surcharges or other charges imposed by the host resort. Ordinarily, daily maid service will not be available. However, at those host resorts offering such a service, it is usually at an additional charge. Any such additional taxes and charges will be collected at the time of check-in or check-out. |

| 10. The resort accommodations may be used only for personal and non-commercial purposes. Sale or rental of the resort accommodations is expressly prohibited. |

| 11. The resort to which you or the Occupants are confirmed may have ongoing sales of full or partial ownership of real estate or other vacation ownership interests. Neither you nor the Occupants are required to participate in any such sales presentation. |

| 12. During the use and occupancy of the reserved resort accommodations, you and the Occupants must observe all of the rules and regulations of the host resort. Violation of such rules and regulations may result in the loss of occupancy rights at the host resort. |

| 13. You agree that your reservation of the resort accommodations and the use and occupancy of such accommodations shall be governed by the laws of the State of Florida. In addition, by completing a reservation, you agree that all disputes between you and the Providers shall be subject to the exclusive subject matter and personal jurisdiction of the courts in Miami-Dade County, Florida. In the event of litigation between you and the Providers, the prevailing party shall be entitled to all costs incurred, including reasonable attorney's fees. |
